The Commerce Commission has concluded its year-long investigation into New Zealand’s mobile telecommunications services market, re-iterating its earlier provisional findings that competition is healthy, despite strident complaints on its provisional findings.
The Court of Appeal’s judgment, released today, dismissed Chorus’ appeal to overturn the High Court’s judgment in April this year on the unbundled bitstream access (UBA) price set by the Commerce Commission’s (ComCom) initial pricing principle (IPP) process.
Chorus has stated that the Final Pricing Principle (FPP) processes should ensure that the regulated price for broadband services is grounded in the reality of New Zealand’s circumstances.
Chorus has entered into a conditional agreement with Crown Fibre Holdings (CFH), which gives it the option to bring forward part of CFH’s existing investment funding earlier in the build of the ultra-fast broadband (UFB) network.
The Commerce Commission (ComCom) will be releasing an issues paper to hear views on whether the two new and unregulated unbundled bitstream access (UBA) services, Boost HD and Boost VDSL, proposed by Chorus on 14 May, fall within the category of regulated UBA service.
